Today I will tell you how the incompetent work of Marta Couto, Jaime Roriz’s lawyer, seriously harmed me.
Here is the first part of this story:
I had previously told you that I had looked for another lawyer because after 8 months, Marta Couto had not been able to elaborate the action against those who had swindled me.
After consulting with several lawyers, I also discovered that it was absurd to ask for the 50,000 euros of compensation that she intended to ask for; first of all, because in Portugal they do not give much importance to non-patrimonial damages and because what is accepted as non-patrimonial damages, are really ridiculous amounts that are not going to compensate you in any way for the nightmare that you have lived.
After having gone to trial at the Justice of the Peace Court because João Valente, the main culprit of my being swindled in the sale of the house, sued me for defamation to steal more money from me, I also realized that Marta Couto had handled this case in the worst possible way.
When we are facing a defamation complaint, even if the defendant is right, the most advisable thing to do and what any lawyer would recommend is to deny everything since there will be no evidence to prove that the defendant was indeed the one who “defamed”.
In my case, dealing with 2 negative reviews posted through a social network, the easiest thing to do would have been for Marta Couto to respond saying that we had not posted those reviews.
My current lawyer told me that, even if we were absolutely right and had plenty of evidence to prove that we were right to leave those reviews, it is very complicated to go and say that yes, it was us.
That is, thanks to Marta Couto we were condemned, and we had to pay 1,000 euros to the corrupt notary who had sold us the house illegally.
Diego thinks that surely Marta Couto did it this way so she could get more money from us.
On the other hand, as I have already told you in other posts Marta Couto was the one who sent the letters of interpellation in March 2023.
My current lawyer also told me that these letters were not properly drafted since it should be perfectly detailed, which were the damages that the illegal sale of the house had caused me, which Marta Couto did not do.
As this lady was always delivering things with deadlines about to expire, you can imagine the quality of her work if she did everything in a hurry.
The most serious thing is that after the interpellation letters are sent, the deadline to deliver the action in court is 6 months. If the action is not served within that time, the right to claim on that very ground is lost.
So now, my current attorney must try to turn the situation around in order to get the action into court.
So, you can see all the trouble an incompetent lawyer can cause you.
Good thing I got another lawyer, but I made the mistake of giving Marta Couto too much time to do the work she had to do.
In short, this lady is far from being able to do anything right because the only thing she does in that law firm is to manage things with deadlines about to expire and in a hurry.
That is why they have such bad reviews and that is why there were several comments in the previous post from people who had lost cases due to the incompetence of this law firm.
I don’t know if with the lawyer I am now with I will be able to win and be compensated for the nightmare I have had and most important, to get justice; what I do know is that with Marta Couto I would have lost everything.
